Platform Item 14: The 14th Amendment

Section 1:

All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.  No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. 

Section 2:

Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State excluding Indians not taxed.  But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State. 

Section 3:

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military under the United States or under any State, who having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State Legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in Insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.  But Congress may by a vote of two thirds of each House remove such disability. 

Section 4:

The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.  But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellions against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

Section 5:

The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article. 


The 14th Amendment Must Itself Be Amended

The Tea Party Movement would support a Constitutional Amendment to revise the 14th Amendment as follows:

Section 1: 

Citizenship should not bestow upon persons born in this country to parents who are here illegally. 

Equal protection should be provided only to citizens and to persons under the jurisdiction of the United States who are here by invitation.  It must not be extended to foreign enemies caught within our borders nor to persons who otherwise arrive in this country illegally. 

Section 2:

Clarify that those persons included in the count should be registered American citizens.

Argument

We have a problem with anchor babies born to persons who flood our coastal hospitals after entering the country illegally for the sole purpose of having their baby born in the United States and thus enjoying immediate citizenship.  A revision to bestow citizenship only to those persons in the United States legally would eliminate the magnet that draws mothers to the US and results in millions of dollars of unpaid hospital bills and often new wards of the state. 

There is also some convoluted logic that has one Attorney General intent on providing Constitutional Protection to enemy combatants that were captured on foreign lands and maintained outside the shore of the US.  This same individual has taken it upon himself to provide Constitutional rights to a terrorist intent on blowing up a commercial airliner over Detroit.  If Eric Holder has a problem understanding that these are our nation's enemies and more appropriately should be covered by articles of war then this apparently needs clarification. 

There is also much question regarding the census as it relates to who should be counted.  It would already be clear to me that only persons found to be in the country legally should be a part of the count and those here illegally should be considered transient and in the process of being deported.  We owe no obligation to provide representation to persons here illegally, we only owe them a trip out of the country.

    I agree that this amendment would be suitable. The issue is compassion. How dare we kick out the parent(s) of an unborn child and leave the baby abandoned. Take the child back to Mexico or wherever you came from, but what do you think about leaving the child behind with legally immigrated relatives or adoptive parents? So do you consider all children born to illegals, illegal or naturalized? I believe the possibility of separation or having to go back with the child is a serious deterrent, let alone the possibility of incarceration or deportation.

      The proposed amendment would refuse citizenship to the children that were born in the United States to persons here illegally.  As such the child would naturally be deported with the mother and father.   There would be no purpose to permit leaving the child behind with relatives who are legally in the United States.

      The second part of the platform would prevent persons here illegally from being included in any census count.
