Supreme Court on the 2nd Amendment
In a ruling on June 28 the US Supreme Court voted 5 - 4 to protect the right of Mr. McDonald, a Chicago resident to own a handgun for personal protection in his home. Mr. McDonald's suit was a result of his desire to protect himself in a neighborhood that the city itself recognizes is out of control.
I am offended by this 5 - 4 vote. I am offended because that ruling should have been 9 - 0 in favor of this Chicago citizen to own his own firearm. These rulings are to interpret the Constitution, not to determine whether the justices agree with the Constitution. The 2nd Amendment is clear: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed." What is it about this that Justices Ginsburg, Breyer, Stevens and Sotomayor do not understand? Worse, what might we expect from a Justice Kagan? I fear that the confirmation of Elena Kagan will simply continue the insanity that has permeated the Supreme Court for fifty years now. I care not whether these justices are liberal or conservative. I care only that they read the Constitution and make their decisions based upon what it says, not based upon what they would like it to say.
