Obamacare Unconstitutional

Judge Roger Vinson of the U.S. District Court for the Northern District of Florida has issued his ruling on the case that was joined by 26 states to challenge the Constitutionality of the Obama Healthcare Bill.  He accepted arguments that have been made here and in many other locations that state that the US Government lacks the authority to mandate that citizens purchase any product.  Further we argued and he acknowledged that the lack of a severability clause in the original bill renders the entire bill then unconstitutional.

We have the momentum.  What must be done now?  We must play hardball.  It appears that the Obama Administration is ignoring this ruling and will continue to implement Obamacare under the presumption that ultimately this will need to be decided by the Supreme Court.  This may be right but these state AG's must petition the court to enforce this ruling if they continue their plans to implement.  Judge Vinson was very clear in his ruling that this bill is unconstitutional and as of January 31 this law is dead.

More importantly, any action by the House or the Senate to find a way to "fix" Obamacare must be resisted.  The bill must be repealed in total.   After and ONLY after repeal should we consider moves to resolve some of the real problems within the healthcare and insurance industry.  I refer you to the following platforms Platform Item 1 and Platform Item 23 for additional ideas as to what a healthcare bill should include.
